Penguin Pilot — Terms for Visitors

For anyone using a page or link created by a Penguin Pilot customer

Who this is for

You’ve probably arrived here from a link someone sent you — a client dashboard, a document portal, a booking page, a form, a feedback link, an event sign‑in, a document to sign, or a brand board.

These pages run on Penguin Pilot, software made by The Network Software Limited (trading as Penguin Pilot). But the page you’re looking at belongs to the business that sent you the link — their business. We just provide the software underneath.

This is short on purpose. It’s about your use of the page, nothing more.

1. Who you’re actually dealing with

1.1 The business that sent you the link decides what’s on the page, what it asks you for, and what happens to the information you give.

1.2 That business — not us — is responsible for the content, for the accuracy of anything shown, and for how your personal information is handled. If you have a question about any of that, contact them directly. Their details will be on the page.

1.3 We provide the technology. We don’t check, approve or endorse what a business publishes.

2. Using the page

2.1 You may use the page for the purpose it was sent to you for.

2.2 Please don’t:

• share a link you were given privately with people it wasn’t meant for;
• try to access parts of the system you weren’t given a link to;
• submit false information, or information about someone else without their permission;
• upload anything unlawful, harmful, or that you don’t have the right to upload;
• probe, scan, overload or attack the page or the systems behind it; or
• use anything on the page for a purpose the business that published it wouldn’t reasonably expect.

2.3 We may block access, remove content or disable a link if we reasonably believe it’s being misused.

3. About links

3.1 Links are usually long and hard to guess, but a link is not a password. Anyone who has the link can open the page.

3.2 Links can expire or be revoked at any time by the business that created them, or by us. A page that worked yesterday may not work today.

3.3 Please treat a link you’ve been sent as private.

4. Your information

4.1 When you use the page, information you enter goes to the business that published it. That business decides what happens to it — how long they keep it, who they share it with, and what they use it for. Their privacy statement applies, not ours.

4.2 We hold that information on their behalf, and we don’t use it for our own purposes.

4.3 We do collect some limited technical information to run the page securely and reliably — things like your IP address, browser type, and the time you accessed it. Where a page is used for signing a document or an event sign‑in, we also record an audit trail so the business can prove what happened and when. Our Privacy Policy explains this.

4.4 To access, correct or delete information about you, contact the business that sent you the link. If you can’t reach them, or you’re not sure who they are, email us at support@penguinpilot.ai and we’ll help you identify them and pass your request on.

4.5 We use cookies and similar technologies to make the page work and keep it secure. Section 9 of our Privacy Policy explains the cookies we use.

5. Signing documents

5.1 If you’re here to sign a document, the document and its contents are the responsibility of the business that sent it. We don’t draft, check or advise on it.

5.2 By signing electronically you’re agreeing to sign in electronic form. In New Zealand, an electronic signature can be legally binding under Part 4 of the Contract and Commercial Law Act 2017.

5.3 This is a real signature on a real document. If you don’t understand what you’re signing, or it matters, get legal advice before you sign. Don’t sign it because a link told you to.

5.4 We record an audit trail — the time, the IP address and a cryptographic record of the document — so the parties can show what was signed and when. Download and keep your own copy of anything you sign. We hold the record for the business that sent it to you, and it goes when they stop using the platform. Don’t rely on us to still have it.

6. What we don’t promise

6.1 We provide these pages “as is”. We don’t promise they’ll always be available, error‑free, or that anything on them is accurate, complete or current.

6.2 To the extent the law allows, we’re not liable to you for any loss arising from your use of a page, from anything on it, from a link expiring, or from anything the business that published it does or doesn’t do.

6.3 Nothing here affects your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 if those apply to you as a consumer.

7. Problems

7.1 If something on a page is wrong, contact the business that published it.

7.2 If you think a page is unlawful, deceptive, infringing, or misusing your information, tell us at support@penguinpilot.ai and we’ll look into it.

7.3 If you’d like a link to stop working, ask the business that sent it. If they don’t respond, tell us.

8. General

8.1 These terms are governed by New Zealand law.

8.2 We may update them. The version published when you use the page is the one that applies.

8.3 If you’re a Penguin Pilot customer, our Platform Terms of Service apply to you instead.
